These Terms of Service (the “Terms”) apply to your access and use of the Kuvo website, mobile application ("Kuvo on the Go"), voice-AI services, and proprietary speaker devices ("Kuvo") (collectively, the “Kuvo Service”). These Terms are a legally binding agreement between you and Kuvo Inc., a Delaware corporation. By using any part of the Kuvo Service, you agree to these Terms.

1. Privacy Policy
Please review our [Privacy Policy] to understand how we collect, use, and protect your personal information. Your use of the Kuvo Service constitutes agreement with our Privacy Policy.

2. Eligibility and Child Use
The Kuvo Service is marketed to families and children, but account creation and purchases may only be made by adults (18+). Children under 13 may use Kuvo under the supervision and consent of a parent or guardian. Kuvo does not knowingly collect data from children without parental consent and complies with the Children’s Online Privacy Protection Act (COPPA).

3. Modifications
Kuvo may revise these Terms at any time. Notice of changes may be provided via email or on our website. Your continued use of the Kuvo Service after changes become effective constitutes acceptance.

4. Account Creation and Security
You are responsible for maintaining the confidentiality of your account and are liable for all activity under your account. You agree to provide accurate and current information.

5. Kuvo Product Purchases
All physical products, including the Kuvo speaker, may be purchased directly from our site or authorized sellers. Prices do not include shipping or applicable taxes unless otherwise stated. Orders are subject to availability and confirmation. Risk of loss transfers to you upon our delivery to the carrier.

6. Lifetime Limited Warranty & Refund Policy
Kuvo offers a lifetime limited warranty against manufacturing defects for its hardware products, including Kuvo speakers. Batteries are warrantied for 3 years of average use. Refunds or store credit are available for products subject to a valid warranty claim initiated within 30 days of delivery. See our [Refund Policy] for full details.

7. Use of the Kuvo Service
Kuvo licenses you a limited, non-exclusive, non-transferable right to access and use the Kuvo Service and Kuvo content for personal, non-commercial use. You may not copy, reverse engineer, or misuse Kuvo software or hardware.

8. Content and Intellectual Property
Kuvo and its licensors own all rights to the Kuvo Service and content (including audio, code, AI models, stories, and graphics). You may not use, modify, or distribute content without express permission. User-generated content may be submitted and remains your property, but you grant Kuvo a license to use it as necessary to provide the service.

9. App Store Licenses and SMS
Use of the Kuvo iOS or Android apps is subject to App Store Terms. By opting into SMS communications, you agree to receive messages including order updates or service notifications. Message and data rates may apply. Reply STOP to unsubscribe.

10. Prohibited Conduct
You agree not to:

Violate any law
Infringe intellectual property
Misuse Kuvo’s name, logo, or technology
Interfere with the Kuvo Service’s operation or security
Upload harmful, deceptive, or inappropriate content

11. Third-Party Content and Services
The Kuvo Service may include third-party links or integrations. Kuvo is not responsible for external services or their terms and policies.

12. Disclaimers
THE SERVICES AND CONTENT ARE PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. We make no warranty that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness or reliability of any Content.

Kuvo cannot guarantee the safety or quality of any physically altered Kuvo products or any unauthorized products that may use Kuvo component parts. Caution should be used when purchasing any unauthorized or physically altered Kuvo products.

You agree that any use of the Kuvo Services is at your own risk. If you rely on any content generated or distributed through Kuvo Services—including text, audio, educational prompts, or interactive dialogues—you do so solely at your own risk. While we strive to offer high-quality experiences, Kuvo cannot guarantee the accuracy, reliability, availability, effectiveness, or correct use of content you receive via our platform. Your discretion and supervision are essential, particularly when Kuvo Services are accessed by minors.

At Kuvo, we employ advanced generative artificial intelligence (AI) and associated AI technologies to curate and display various forms of content on our platform. While our goal is to deliver a seamless and engaging user experience, it is important to recognize the inherent limitations of AI-generated content. Due to the nature of AI, the content may contain inaccuracies, misrepresentations, or elements that do not fully align with actual objects, legal standards, or factual information.

Kuvo does not make any representations or warranties that any AI-generated content or output that may be encountered on the platform—including but not limited to text, images, audio, video, or other multimedia—is accurate, complete, or reliable. The generated content or output does not reflect the opinions, beliefs, or values of Kuvo as an organization. We appreciate your patience and cooperation as we continue to refine our use of AI technology and aim for continuous improvement in content quality and accuracy.

13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KUVO’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE KUVO PRODUCT OR SERVICE. KUVO SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

14. Indemnification
You agree to indemnify and hold harmless Kuvo Inc. from any claims or losses related to your violation of these Terms or misuse of the Kuvo Service.

15. Dispute Resolution and Arbitration
All disputes arising out of or relating to these Terms or your use of the Services shall be governed by the laws of the State of Delaware, without regard to its conflict of laws principles.

You and Kuvo agree to resolve any such disputes exclusively through final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court. This means that you waive your right to a trial by jury or to participate in a class action lawsuit.

Exceptions to this arbitration agreement include:

Claims that qualify for resolution in small claims court, and
Actions seeking injunctive or equitable relief to prevent the actual or threatened misuse or infringement of intellectual property rights.

This arbitration agreement shall survive the termination of your relationship with Kuvo.

16. Termination
Kuvo may suspend or terminate your access to the Kuvo Service for violations of these Terms. You may terminate your use at any time by deleting your account and ceasing use.

17. General Provisions
These Terms represent the entire agreement between you and Kuvo. If any part is found unenforceable, the rest remains in effect. Kuvo’s failure to enforce any right shall not be deemed a waiver.
